The brief is based on a flawed reading of history and the role of freedom of speech in governance. The framers of our constitutional system thought they were building a republic with limited suffrage and many checks on democracy in the United States. The Electoral College, as it was conceived by the framers, was anything but democratic. State legislatures could select the electors without even allowing eligible voters to participate in the process. Just a small fraction of citizens and residents, male white landowners, were eligible to vote, and even they were subject to varying standards. The Senate back then was selected by state legislatures instead of democratic voting. Speech The Freedom Of Speech.The First Amendment guarantees freedoms concerning religion, expression, assembly, and the right to petition. It guarantees freedom of expression by prohibiting Congress from restricting the press or the rights of individuals to speak freely. It also guarantees the right of citizens to assemble peaceably and to petition their government.
